Kenneth Smith: Stay of execution granted

We were late in getting this, but thinking of the possibility of an execution today, we were relieved to find this:

US District Court Judge Gregory Frost issued a stay of execution to Kenneth Smith on Friday, July 8th. Smith was scheduled to be executed on July 19, 2011 for the 1995 murders of Lewis and Ruth Ray.

The ruling made by Judge Frost said that Ohio’s execution procedures are a “haphazard application” of its death penlaty protocol. He also wrote, “Ohio pays lip service to standards it then often ignores without valid reasons, sometimes with no physical ramifications and sometimes with what have been described as messy if not botched executions.”

Another stay issued in execution of killer

CARSON CITY — A stay of execution has been issued for killer Robert McConnell, who was scheduled to die Feb. 1. It is the second time McConnell was scheduled to be put to death before asking for a stay to pursue further appeals in his case.

Howard Skolnik, director of the state Department of Corrections, confirmed that the stay was signed on Friday.

McConnell had already been transferred from the maximum security prison in Ely to the Nevada State Prison in Carson City, where the death chamber is located.

He was scheduled to die in June 2005, but 39 minutes before he was scheduled to die by lethal injection he asked for a reprieve.
